New legal documents come into effect from September 2015

There are several legal documents of the Vietnamese Government, the Prime Minister and ministries coming into effect from September 2015, as follows:
1. Decree No. 60/2015/ND-CP dated 26 June 2015 of the Government amending and supplementing some articles of the Decree No. 58/2012/ND-CP dated 20 July 2012 of the Government detailing and guiding the implementation of some articles of the Law on Securities (amended) took effect as from 1 September 2015. According to the Decree, the room for foreign investors joining Viet Nam’s stock market will be loosened.

2. Decree No. 61/2015/NĐ-CP dated 9 July 2015 of the Government stipulates new job creation support policies and the National Employment Fund, with specific provisions on policies to support laborers sent to work overseas under contracts. The Decree took effect as from 1 September 2015.

3. Decree No. 62/2015/NĐ-CP dated 18 July 2015 of the Government detailing and guiding the implementation of some articles of the Law on Civil Judgment Enforcement took effect as from 1 September 2015.

4. Decree No. 63/2015/ND-CP dated 22 July 2015 of the Government providing policies towards redundant employment in accordance with the restructuring of state-owned one member limited companies, and replacing the Decree No. 91/2010/NĐ-CP will take effect as from 15 September 2015.

The Decree expands the adjustment of some enterprises, which are merging, acquiring or separating as well as supplements policies on redundant employment.

5. Decision No. 28/2015/QĐ-TTg dated 21 July 2015 of the Prime Minister on credit policy for households escaping poverty took effect as from 5 September 2015. According to the Decision, Viet Nam Bank for Social Policies aims to enhance production and business for stable livelihoods and sustainable poverty reduction.

6. Decision No. 30/2015/QĐ-TTg dated 31 July 2015 of the Prime Minister amending and supplementing several regulations on financial management of the Bank for Social Policies (BSP), which were issued together with Decision No.180/2002/QD-TTg dated 19 December 2002, will take effect as from 15 September 2015.

According to the newly-issued decision, the BSP can preferentially borrow and access idle funds or capitals with low interests, based on the balance of the State budget, the official development assistance source, aid and other low-interest capital sources.

7. Decision No. 32/2015/QD-TTg dated 4 August 2015 of the Prime Minister on the management and use of cars at state agencies, public non-business units and single-member limited liability companies with 100% charter capital held by the State defines standards, quota and regulations on cars for each dignity will take effect as from 21 September 2015.

8. Decision No. 34/2015/QD-TTg dated 14 August 2015 of the Prime Minister issuing a list of prioritized programs/projects which are be considered for the Government’s guarantee, replacing the Decision No.44/2011/QD-TTg dated 18 August 2011 will take effect as from 30 September 2015.

Under the Decision, the prioritized projects include those in energy, mineral exploitation and processing or commodity production and export service provision in line with the country’s direction on socio-economic development. Special projects which are decided by the Government and programs/projects on transport infrastructure developments (such as highways) with the total investment from VND10 trillion (US$450 million) and will also be considered for Government’s guarantee.

9. Besides, other legal normative documents also come into effect from September 2015, including:

- Circular No. 09/2015/TT-NHNN dated 17 July 2015 of the State Bank of Vietnam on debt trading of credit institutions and foreign bank branches. This Circular replaces Decision No. 59/2006/QD- NHNN dated 21 December 2006 on issuing Regulations on debt trading of credit institutions and came into effect as from 1 September 2015;

- Circular No. 27/2015/TT-BLĐTBXH dated 24 July 2015 of the Ministry of Labor, Invalids and Social Affairs guiding the activities of collection, storage and synthesizing information on labor market took effect as from 10 September 2015;

- Circular No. 28/2015/TT-BLDTBXH dated 31 July 2015 of the Ministry of Labor, Invalids and Social Affairs guides the implementation of Article 52 of the Law on Employment and Decree No. 28/2015/NĐ-CP on guidelines for some Articles on unemployment insurance of the Law on Employment on unemployment allowances and insurance. The Circular will take effect as from 15 September 2015.

Based on new regulations, monthly unemployment allowance level of the employee equals 60% of the average monthly wage of six consecutive months;

- Joint Circular No. 14/2015/BGDDT-BTC-BLDTBXH dated 16 July 2015 of the Ministry of Education and Training, the Ministry of Finance and the Ministry of Labor, Invalids and Social Affairs took effect as from 1 September 2015. The Joint Circular provides that all students who have graduated from secondary schools and attend vocational junior colleges will be reduced by 50% of tuition;

- Joint Circular No. 16/2015/TTLT-BYT-BTC dated 2 July 2015 of the Ministry of Health and the Ministry of Finance amending Clause 5 Article 13 of the Joint Circular No. 41/2014/TTLT-BYT-BTC dated 24 November 2014 guiding the implementation of health insurance took effect as from 1 September 2015.
